Florida Private Time Frames


Step 1: Notice
  • Owners must record a Notice of Commencement and post a copy at the jobsite before the work starts.

  • Subcontractors & Material Suppliers: Serve Notice to Owner on the contractor and on all parties in the chain-of-contract with the owner and on all persons designated in the Notice of Commencement within 45 days of first furnishing labor and/or materials or the date the owner makes the final payment, whichever comes first.
  • Specially Fabricated Material: Serve notice as soon as possible, but no later than 45 days of first fabrication of the specially fabricated materials.

Step 2: Lien
  • File within 90 days of last furnishing. Serve the owner before recording or within 15 days after recording.

Step 3: Foreclosure
  • Within 1 year from the date of the recorded lien.
