Indiana Public Time Frames


Step 1: Bond Claim
  • Public Works Division (Title 4),  State Public Works (Title 5) and Local Governments/Political Subdivisions (Title 36):   File duplicate Verified Statement Claim with the governing body and notify the surety and deliver a copy of the claim to the principal within 60 days of last furnishing labor or materials. The contractor/supplier shall also inform the public division that the surety has been notified.
  • Department of Transportation (Title 8):  Within 1 year after acceptance of labor, material or services by the Commissioner furnish the surety a statement of the amount due.
  • The public division shall supply the claimant with any information the claimant requires to notify the surety.

Step 2: Suit Against Bond
  • State Public Works (Title 5) and Local Governments/Political Subdivisions (Title 36): Not until 30 days after filing with the governing body the duplicate statements of the amount owed but within 60 days after the date of the final completion and acceptance of the public work.
  • Public Works Division (Title 4):   Not until 30 days after filing with the governing body but within 1 year after final settlement of the contract with the contractor.
  • Department of Transportation (Title 8):  Not until 60 days after furnishing the surety a statement of amount owed but within 18 months from the final acceptance of the project

Bond Bits

  • Contracts less than $200,000 are excluded from bond requirements.
  • HB1117 was signed on 4/24/17 – Contractors on state educational institution projects will not be required to provide payment bonds on contracts less than $500,000.
  • P3 and BOT projects effective 6/30/19 will require payment bonds.  Act 1374
  • Amount of Bond: 100% of the contract.
