Ohio Public Time Frames


Step 1: Bond Notice
  • Serve prime contractor within 21 days after first furnishing. See Speed Bumps for dollar thresholds.

Step 2: Bond Claim
  • Serve the surety a formal statement of the amount due not later than 90 days after the project is accepted.

Step 3: Suit
  • After 60 days from the formal statement but not later than 1 year after acceptance of the Public Works Project.

Bond Bits

  • Amount of Bond—100% of contract price.
  • Contracts Excluded—No specific statutory provision.
  • P3 - Payment Bonds are not required. Coverage can be determine within the Notice of Commencement. Public improvement lien rights only when funds are still payable to the General Contractor.

Ohio Public Improvement Lien Time Frames


Step 1: Notice
  • Serve prime contractor within 21 days after first furnishing.

Step 2: Public Improvement Lien
  • The lien against contract funds must be served on the public authority within 120 days of the last furnishing of materials or services. A copy of the sworn statement is also served on the general contractor as well as any intermediate subcontractors. The Attested Account Affidavit is also filed with the County Recorder within 30 days.

Step 3: Suit
  • Within 60 days from notice to commence.
