Oregon Public Time Frames


Step 1: Notice
  • No Requirement: NACM suggests serving notice within 45 days of first furnishing to prompt payment

Step 2: Bond Claim
  • Serve the public authority and contractor must be received no later than 180 days after last furnishing.

Step 3: Suit Against Bond
  • Within 2 years of last furnishing.

Bond Bits

  • Contracts less than $100,000 are excluded from bond requirements; $50,000 for highways, bridges and other transportation projects.
  • Amount of Bond: 100% of contract price.
  • P3 HB2750 effective January 1, 2018 Port of Hood River tollway projects law exempts projects from existing public procurement laws but will require Little Miller Act payment assurances.
