Tennessee Private Time Frames


Step 1: Notice
  • Original Contractor: Notice to Owner Prior to beginning work or entering a contract on residential real property.  Residential property:  Building consisting of one to four dwelling units where the owner intends to reside. 
  • Subcontractors and Materialman: Notice of Nonpayment to the owner and contractor within 90 days of the last day of each month of furnishing.  Retainage only is exempt from the Notice of Nonpayment requirement.

Step 2: Lien
  • Serve the owner and file with the register’s office a Notice of Lien and Sworn Statement the earlier of 90 days after completion or 30 days from a Notice of Completion being filed.
  • Residential one to four unit project: Serve the owner and file with the register’s office a Notice of Lien and Sworn Statement the earlier of 90 days after completion or 10 days from a Notice of Completion being filed.
  • Must be severed on owner by the above timeframes not just posted marked.

Step 3: Foreclosure
  • Original Contractor: Within 1 year of completion.
  • Subcontractors and Materialmen: Within 90 days of properly giving and filing the Notice of Lien and Sworn Statement.
