Step 1: Notice

  • Preliminary notices must be filed with the public database within 20 days of furnishing labor, service, material and/or equipment OR within 20 days of the filing of the notice of commencement, whichever is later. 
  • NACM recommends serving a copy on the owner and prime contractor to prompt payment.
  •  

Step 2: Lien

  • Within 90 days from the filing of a Notice of Completion or, if there is no Notice of Completion, within 180 days from final completion of the original contract. See Speed Bumps.
  •  

Step 3: Foreclosure

  • Within 180 days of filing lien.

 

Utah Private Payment Bond Time Frames
(Non-residential projects where construction contract exceeds $50,000)

Step 1: Notice

  • Preliminary notices must be filed and served on the prime contractor within 20 days of furnishing labor, service, material and/or equipment OR within 20 days of the filing of the notice of commencement, whichever is later.
  •  

Step 2: FSuit

  • After 90 days but within 1 year of last furnishing. §14-2-1(5)(b)
