Statute

Step1: Notice
  • Non-Statutory: NACM recommends sending a non-statutory notice in conjunction with first furnishing.
  • Please note the very short window for lien.
  • Leasehold properties: Notice to Owner required in order for anyone in the construction tiers to be able to lien the Owner’s freehold interest. If not served, leasehold lien rights only. Owners have 10 days to object.

Step 2: Lien
  • Within 60 days from last furnishing. 


Step 3: Foreclosure
  • If the date of the expiry of the period of credit is not stated in the claim foreclose within 90 days of last furnishing otherwise within 105 days from last furnishing but no later then 6 months from the registration of lien.
