Statute

Step 1: Notice
  • Non-Statutory: NACM recommends sending a non-statutory notice in conjunction with first furnishing.
  • Please note the very short window for lien.
  • Leasehold properties: Notice to Owner required in order for anyone in the construction tiers to be able to lien the Owner’s freehold interest. If not served, leasehold lien rights only. Owners have 10 days to object.
Step 2: Lien
  • For claims over $32.00, within 60 days from last furnishing or completion of services.
Step 3: Foreclosure
  • Within 90 days of lien filing or 30 days from the date of the mailing of a notice to commence.
