US Virgin Islands Private Time Frames


Step 1: Notice
  • Obtain Notice of Commencement from the office of the recorder in the district in which the real estate improvement is located.
  • Serve notice Prior to furnishing to trap unpaid funds. See Speed Bumps
  • If the owner or the prime contractor, prior to commencing the improvement under thecontract between the owner and prime contractor post a bond: Serve notice of amount due to prime contractor and surety within 60 days of furnishing material or services.

Step 2: Lien
  • Within 90 Days of final furnishing of materials or services.

Step 3: Foreclosure
  • Within 90 Days of recording lien.
  • If the owner or the prime contractor, prior to commencing the improvement under the contract between the owner and prime contractor post a bond: Serve notice of amount due to prime contractor and surety commence suit within I year of furnishing material or services.
