Alabama Private Time Frames

 

Step 1: Notice
  • Notice to Owner, General Contractor and Construction Lender must be received prior to delivery/work and must allow ample time for owner to send (Notice of Objection). Possible Full Price Lien rights. Prior to delivery/work notice should be served 10-15 days before furnishing recommended-see speed bumps.
  • Serving notice is a prerequisite to filing a Mechanic’s Lien when the above is not done timely. Notice must be given to Owner, General Contractor and Construction Lender per case law Payvee Mortgage Co. v. GobbleFite Lumber Co., Inc., 565 So.2d 138 (Ala. 1990).

Step 2: Lien
  • Laborers: Within 30 days of Last Furnishing.
  • Contract with Prime or Sub: Within 4 months of Last Furnishing.
  • Contract with the Owner: Within 6 months of Last Furnishing.

Step 3: Foreclosure
  • Within 6 months after the maturity of the entire indebtedness.
