Crown Project: Similar to federal projects in the US such as work performed on a military base. Payment bonds are not required, but 99% of Crown projects are bonded and should cover three tiers: the general contractor, subcontractor and supplier.
Province Project: Similar to public projects in the US, payment bonds are required, but may only cover someone hired by the general contractor. Suppliers should always get a copy of the bond and read it to verify coverage and the time frames for noticing.
Preliminary Notice: 60 days from first furnishing notice maybe required within the bond. Bond Claim Notice: 90 days from last furnishing maybe required per bond.
Ontario Construction Act (Province Project) effective7/1/18 – See bond for bond claim and suit requirements. Ontario payment bonds must extended to subcontractors and persons supplying labor or material. Amount of Bond: 50% of contract price. P3 projects are consider public contracts payment bonds required.
