Step 1: Notice
No Requirement. NACM suggests serving notice
45 days
from last furnishing to prompt payment.
There are no provisions for lien rights on rental equipment in Delaware.
Step 2: Lien
Prime Contractor: Statement of claim within
180 days
after the completion of the structure.
Others: Statement of claim within
120 days
of last furnishing.
Step 3: Foreclosure
The proceedings to recover the amount of any claim shall be by writ of scire facias. (an order for the owner to appear before the court).
In essence foreclosure and the filing of the statement of claim (lien) are concurrent.
