Step 1: Notice
Notify prime contractor within
45 days
of first furnishing or fabricating.
Except for laborers, notice is not required when contracting with the prime contractor (principal).
Step 2:
Sworn Notice of Non-payment/Bond Claim
Notice of Non-Payment is a Sworn Statement under oath and must be served on parties by the 90th day of last furnishing.
Allow ample time for service by the 90th day
Step 3: Suit
Within
1 year
from last furnishing.
Bond Bits
Amount of Bond: 100% of contract price.
Contracts less than $100,000 are excluded from bond requirements for state projects, $200,000 for county and city projects.
P3 Payment bonds are required per FS 287.05712 – notice and filing timeframes follow public statute.
