Hawaii Private Time Frames


Step 1: Notice
  • Commercial: No Requirement: NACM suggests serving notice 45 days from last furnishing to prompt payment.
  • Residential: Prime Contractor Requirements Prior to Furnishing. See Speed Bumps.

Step 2: Lien
  • Written Demand for Payment prior to the Application for Mechanic's and Materialman's Lien.
  • Serve and file the Application for Mechanic's and Materialman's Lien and Notice of Mechanic's and Materialman's Lien and Demand within 45 days after the notice of completion (NOC). If no (NOC) within 1 year and 45 days after actual substantial completion or abandonment.

Step 3: Foreclosure
  • Within 3 months after lien attaches.
