Illinois Private Time Frames


Step 1: Notice
  • NACM suggests a non statutory notice 45 days from first furnishing to prompt payment.
  • Owner-occupied single-family residences: Serve owner and lender within 60 days from first furnishing.

Step 2: Lien
  • Commercial:
    • Serve owner and lender "Subcontractor's Notice of Intention to File Mechanic's Lien" within 90 days of last furnishing.
    • File "Subcontractor's Notice of Intention to File Mechanic's Lien" within 4 months of last furnishing. See Speed Bumps
  • Owner-occupied single-family residences: Serve owner and lender "Subcontractor's Notice of Intention to File Mechanic's Lien" within 90 days of last furnishing. File lien within 4 months from last furnishing. In addition Prime Contractors must provide written notice the Owner within 10 days after recording the mechanics lien.

Step 3: Foreclosure
  • Within 2 years after completion of contract or furnishings or within 30 days of receiving Notice to Commence Suit.
