Indiana Private Time Frames


Step 1: Notice
  • Commercial: No requirement. NACM suggests serving notice 45 days from last furnishing to prompt payment.
  • Residential: Owner-occupied repair or renovation notice to owner within 30 days of first furnishing. Not required to be recorded.
    New construction notice to owner within 60 days of first furnishing. Copy of the notice must be filed with the county recorder. Notice and recording handled by Attorney. Request should be made to MLBS within 45 days of first furnishing.

Step 2: Lien
  • Commercial Projects: Within 90 days from last furnishing.
  • Residential Projects: Within 60 days from last furnishing.
Step 3: Foreclosure
  • Within 1 year after the lien is filed, or within 30 days after receipt of a written notice from the owner to commence.
