Step 1: Notice
  • No contract with the prime contractor: Notify prime contractor within 30 days of first furnishing.

Step 2: Bond Claim
  • Filed with the proper public authority within 30 days after completion of project. Claims may also be filed at any time after the 30 day period if the public corporation has not paid the full contract price.

Step 3: Suit
  • After 30 days, but within 60 days from completion.

Bond Bits

  • Contracts less then $25,000 are excluded from bond requirements.
  • Amount of Bond: Generally not less than 75% of the contract price. In contracts where no part of the contract price is paid until after completion of the improvement, the amount of the bond may be fixed at not less than 25 % of the contract price.
