Massachusetts Private Time Frames


Step 1: Notice
  • Serve the Original Contractor, Notice of Identification, within 30 days from first furnishing to trap unpaid funds.

Step 2: Lien
  • Notice of Contract:  File within the earliest of 90 days after the last day a prime contractor or anyone claiming by, through or under him, performed or furnished labor and/or materials to the project, or furnished rental equipment, appliances, or tools. (typically applicable).  File within 60 days of the recording of a Notice of Substantial Completion by owner or General Contractor.  File within 90 day of the recording of a Notice of Termination by owner or General Contractor.

  • Statement of Account:  File within the earliest of 120 days after the last day a prime contractor or anyone claiming by, through or under him, performed or furnished labor and/or materials to the project, or furnished rental equipment, appliances, or tools. (typically applicable).  File within 90 days after the filing of a Notice of Substantial Completion (if one was filed) executed by the owner and/or general contractor.  File within 120 days after the recording of a Notice of Termination by the owner and/or general contractor.

Step 3: Foreclosure
  • Within 90 days after the recording of the statement of account.
