Michigan Public Time Frames


Step 1: Notice
  • Serve notice on the principal contractor within 30 days of first furnishing.

Step 2: Bond Claim
  • Serve written notice, on the principal contractor and governmental unit within 90 days from last furnishing.
  • Highway Projects: In addition a subcontractor or supplier must give notice via certified mail, return receipt requested, to the board of officers or agents contracting on behalf of the state (usually the Michigan Department of Transportation) in duplicate, within 60 days after the claimant last furnished its labor or material

Step 3: Suit Against Bond
  • Non-Highway: After 90 days, but within 1 year, of final payment to the general contract.
    Highway Projects: Any time within 1 year after completion and acceptance of the project.

Bond Bits

  • Contracts less then $50,000 are excluded from bond requirements.
  • Amount of Bond: Not less than 25% of the contract price.
