Missouri Private Time Frames


Step 1: Notice
  • Suppliers and Subcontractors contract with General Contractor: Commercial projects NACM suggest serving notice 45 days from last furnishing to prompt payment.
  • Original Contractor or direct to property owner: Notice required before first invoice and prior to payment.
  • Residential New Construction: Claimants, record Notice of Rights within 5 days of planned closing should the owner for whom work was being performed filed with the recorder of deeds a Notice of Intended Sale 45 days before the sale. Notice of Intended Sale not being filed will not waive claimant’s lien rights. (see Private Residential Considerations)
  • Rental equipment:  Serve owner notice within 15 business days of the commencement of the use of the rental machinery or equipment to the property. Must contain rental rate. See Speed Bumps for residential, owner- occupied projects and rental equipment.

Step 2: Lien
  • Serve Notice of Intent 10 days prior to filing lien. File lien within 
    6 months of last furnishing. See Speed Bumps for rental equipment. 60 days from equipment removal date.

Step 3: Foreclosure
  • Within 6 months of lien filing.
