Montana Public Time Frames

Step 1: Notice

Suppliers: Notice to the prime contractor within 30 days of first furnishing.
Notice is not required when contracting directly with the prime contractor (principal).

Step 2: Bond Claim

Notice of a claim must be filed with the owner within 90 days of completion and acceptance of the project.

Step 3: Suit Against Bond

No statutory provisions; Review bond for the terms.

Bond Bits

Contracts less then $50,000 ($7,500 for schools) are excluded from bond requirements.
Amount of Bond: 100% of contract price on state job, not less then 25% on city jobs.
