Step 1: Bond Claim

Within 90 days of completion and acceptance. See Speed Bumps for details.

Step 2: Suit Against Bond

Within 1 year of filing claim.

Bond Bits

Contracts less then $100,000 are excluded from bond requirements.
Amount of Bond: 100% of contract price.
P3 July, 2017 SB635 allows governor to approve up to five P3 agreements and that performance and payment bonds or other security approved by agency be incorporated. Effective through January 1, 2020

New Hampshire Public Stop Notice Time Frames

Step 1: Public Improvement Lien Notice

Serve Notice of Intent to Lien as soon as possible to trap unpaid funds. 30 days after the notice, and every 30 days thereafter, a written account must also be furnished to the owner.

Step 2: Public Imporvement Lien

Within 90 days after completion and acceptance of the project by the State or political subdivision.

Step 3: Suit

Within 120 days of last furnishing.
