New Mexico Private Time Frames


Step 1: Notice
  • Residential: Within 20 days of first furnishing; lender must be notified. 

    Commercial: Within 60 days of first furnishing. A late notice will trap back 30 days. See Speed Bumps for exceptions.

Step 2: Lien
  • Original contractors:  Within 120 days of completion of its contract
    New Mexico HB 179 - As of June 16, 2023 a copy of the lien must be delivered to the owner within 15 days of the filing


Step 3: Foreclosure
  • Within 2 years after the lien is filed.
