New York Private Time Frames

Step 1: Notice

No Requirement: NACM suggests serving notice 45 days from last furnishing to prompt payment.

Step 2: Lien

Commercial: Within 8 months of last furnishing.
Residential: Within 4 months of last furnishing for single family dwellings.

Step 3: Foreclosure

Within 1 year of lien filing. Liens and single family houses may be extended an additional year by filing a notice of extension.
