New York Public Time Frames


Step 1: Bond Claim
  • Written notice to the prime contractor within 120 days of last furnishing.

Step 2: Suit Against Bond
  • Within 1 year from the date on which project is completed and accepted by the public owner.

Bond Bits

  • Payment bond may be waived for public works contracts for less than $100,000 or where the contract is not subject to the multiple contract award requirements of Section 135 of the State Finance Law, waiving the bonds is in the public interest and the aggregate amount of the contract is less than $200,000
  • Amount of Bond: No statutory provision.

New York Public Improvement Lien Time Frames


Step 1: Notice
  • Within 30 days after completion, serve notice of lien to the head of the department or bureau having charge of the improvement and with the comptroller of the state or with the financial officer of the public entity charged with the custody or disbursement of the funds. Within 5 days before or at the same time as the filing of the public improvement lien, the lienor must serve a copy of the lien by certified mail on the contractor and subcontractor.

Step 2: Suit
  • File within 1 year from date the lien was served.
