Statute

Step 1: Notice
  • Non-Statutory: NACM recommends sending a non-statutory notice in conjunction with first furnishing.
  • Please note the very short window for lien.
  • Leasehold properties: Notice to Owner required in order for anyone in the construction tiers to be able to lien the Owner’s freehold interest. If not served, leasehold lien rights only. Owners have 15 days to object.
Step 2: Lien
  • Within 30 days after the completion or abandonment of the contract or of the subcontract.
Step 3: Foreclosure
  • Within 90 days of completion, abandonment or furnishing.
