Step 1: notice
  • Any laborer, subcontractor, or material supplier may serve upon the owner, part owner, or lessee a notice in writing. Risk of losing lien rights when not served should prime not list supplier/subcontractor on affidavit to owner. Notice must include the following: type of work or materials being furnished, amount to become due, contracting with party, identity of well, oil tank/pipeline etc., permit number and county.

Step 2: Lien
  • File within 120 days from the date on which the last labor or work was performed or material was furnished. Serve owner within 30 days of filing.

Step 3: Enforcement
  • File suit within 6 years from filing lien or 60 days of receipt of notice to commence suit.
