Oregon Private Time Frames


Step 1: Notice
  • Within 8 business days of first furnishing notify owner and lender (sending to lender gives super lien priority on new construction). The 8 days does not include Sat. Sun. or holidays. See Speed BumpsNotice not required when direct to owner. 
  • Original Contractor, Residential: See Speed Bumps.

Step 2: Lien
  • File lien the shorter of 75 days from last furnishing or 75 days of substantial completion of construction.
    • Notice of Completion or Abandonment may be posted and recorded upon substantial completion triggering the 75 day lien deadline.
    • Serve (registered/certified) upon owner and mortgagee within 20 days after filing the lien for attorney fees. Notify Mortgagee shown in the county's real property records for priority.

Step 3: Foreclosure
  • Notice of intent to foreclose must be mailed (registered/certified) or personally delivered to the owner and mortgagee by all claimants at least 10 days prior to the commencement of foreclosure suit.
  • File foreclosure suit within 120 days after the claim of lien is filed or 120 days from extended terms if terms are stated in the claim of lien but less then 2 years from lien filing.
