Step 1: Notice
  • Prior to furnishing.

Québec law does not provide for a tier system. It provides that the architect, engineer, supplier of materials, workman and contractor or subcontractor for the work requested by the owner of an immovable, or for the materials or services supplied or prepared by them for the work, all benefit from a legal hypothec on said immovable, regardless of their “tier”. Suppliers to suppliers do not have lien rights. Liens right are for materials or work preformed once notice is served.


Step 2: Lien
  • Within 30 days after the construction works for the whole project have been completed.

Step 3: Foreclosure
  • Within 6 months after the work is completed.
