South Carolina Private Time Frames


Step 1: notice
  • Prime Contractor: File Notice of Commencement within 15 days of first furnishing. See Speed Bumps
  • Subs/Suppliers:  No specific timeframe for serving.  Must be served prior to lien.  Notice should be served quickly since the lien will be limited to unpaid funds at time of receipt by owner.
    • NACM urges all suppliers and laborers to serve notice within 30 days of first furnishing to protect lien rights.

Step 2: lien
  • Notice of Lien served and filed within 90 days of last furnishing.
    • Allow ample time for Sheriff Service

Step 3: Foreclosure
  • Within 6 months of last furnishing.
