South Carolina Public Time Frames


Step 1: Preliminary Notice
  • Notice to the the principal (prime contractor) as soon as possible to trap unpaid funds.  See Speed Bumps for notice exceptions.
    • NACM urges all suppliers and laborers to serve notice within 30 days of first furnishing to protect lien rights.

Step 2: Bond Claim
  • Within 90 days of last furnishing labor, material or services notify general contractor and owner. Notifying public owner gives protection in the event the owner fails to require a payment bond.

Step 3: Suit Against Bond
  • Highway Work: Within 1 year of final settlement.
  • Non-Highway Work: Within 1 year of last furnishing

Bond Bits

  • Contracts less then $100,000 are excluded from bond requirements,
    $10,000 for highway work.
  • Amount of Bond: 100% of contract price except highway projects, 50% of contract price.
