Utah Public Time Frames


Step 1: Preliminary Notice
  • Preliminary notices must be filed with the public database within 20 days of furnishing labor, service, material and/or equipment OR within 20 days of the filing of the notice of commencement, whichever is later and within 10 days of a Notice of Completion filing.
  • NACM recommends serving a copy on the surety and prime contractor to prompt payment.

Step 2: Bond Claim
  • If a bond has not been posted, take Step 2:    Serve written notice to the state or political subdivision within 90 days from last furnishing to allow direct action against the state. MLBS recommends as a precaution to always serve this notice.

Step 3: Suit Against Bond
  • If a bond has been posted, take Step 3:   After 90 days from last furnishing but within 1 year from last furnishing.

Bond Bits

  • Amount of Bond: 100% of contract price.
  • Contracts less then $50,000 are excluded from bond requirements, $100,000 for Division of Facilities Construction and Management (DFCM) projects.
  • P3 Governor signed 3/24/17:  SB204 assures payment bond protection on public-private partnerships and will be 100% of contract price.
