Step 1: Bond Claim
  • Subcontractors and Suppliers: Notice to the prime within 90 days from last furnishing. No notice is required when contracting with the principal (prime contractor).

Step 2: Suit Against Bond
  • After 90 days but within 1 year from last furnishing.

Bond Bits

  • Contracts under $500,000 for non-transportation construction projects are excluded from bond requirements.
  • Transportation contracts under $350,000 are excluded from bond requirements. 
  • The Public-Private Education Facilities and Infrastructure Act of 2002 refers to 2.2-4337 requiring payment bonds.
  • Amount of Bond: 100% of contract price.
