Kentucky Public Time Frames


Step 1: Notice
  • No Requirement: NACM suggests serving notice 45 days from last furnishing to prompt payment.

Step 2: Bond Claim
  • Within 60 days of the last day of the month in which materials were provided. See Speed Bumps.

Step 3: Suit Against Bond
  • No statutory requirement, review bond for terms. See Speed Bumps.

Kentucky Municipal Mechanic's Lien Law Time Frames


Step 1: Public Improvement Lien
  • Within 60 days after the last day of the month in which any labor, materials or supplies are furnished, the lien claimant must file a statement in the county clerk’s office of each county in which labor and materials were furnished. 


Step 2: Suit
  • The contractor may file a written protest with the public authority within 30 days from the date of the delivery of the attested copy, putting in issue the correctness of the amount due the lien or the liability of the fund for payment thereof. If a protest is filed, the lien claimant must institute a suit for the enforcement of the lien and serve a summons on the public authority within 30 days after the written notice of the protest is mailed to the claimant.

Bond Bits

  • Contracts less than $100,000 are excluded from bond requirements on local public agency contracts.
  • Contracts less than $40,000 are excluded from bond requirements on state contracts.
  • Amount of Bond: 100% of contract  price.
